Data residency

There is no general legal requirement to store data in Spain; GDPR rules on international transfers govern. In practice, public-sector contracts are gated on certification under the Esquema Nacional de Seguridad (Real Decreto 311/2022), which drives EU/EEA hosting requirements and, for Medium and High classified systems, mandatory certification of the provider.

What shapes cloud procurement here

Public-sector and large-enterprise procurement runs through the Ley 9/2017 public contracts regime, with tender documentation and bids submitted in Castilian Spanish and, in Catalonia, the Basque Country, Galicia and Valencia, often in the co-official language as well. ENS certification under Real Decreto 311/2022 functions as a gating prerequisite for supplying public administrations at any level. With four hyperscaler regions physically in-country, the residency question is largely settled and buyer conversations tend to centre on migration effort, cost control and Spanish-language delivery capacity rather than on whether local hosting is possible.
